WYAMs commitment to you

West Yorkshire Advanced Motorcyclists (WYAMs) is committed to protecting personal data and privacy.  We take our Data Protection responsibilities extremely seriously and understand how valuable your personal data is.  The information you provide to us will only be used for its intended purpose.  It will not be shared with third parties unless required by law.

When we collect your personal data we will tell you:

  • what your information will be used for
  • who it may be shared with.

We fully recognise the importance of data security and will manage all personal data in a proper and secure manner.

What your information will be used for:

How we use your information will depend on your membership status.

For Associates and new members - the information we hold for you will be used for Group administration purposes and for administering and arranging your training with members of our highly trained and qualified Training Team.

For Associates and Full members – the information we hold for you will be used for Group administration purposes and, unless you have asked us not to, for sending you our monthly newsletter and informing you about training and social events including fundraising for our adopted charity.

Who your information may be shared with:

Who we share your information with will depend on your membership status.

For Associates and new members - the information we hold for you will be shared with appropriate members of our Training Team for arranging training and for training administration purposes.  It may also be shared with IAM RoadSmart Head Office for training purposes and for arranging the Advanced Motorcycle Test.

For Associates and Full members – specific and relevant sections of the information that WYAMs Membership Secretary holds for you will be shared with the Group Officials listed below.  These officials are: Group Secretary, Training Administrator, Newsletter Editor, Webmaster and Social Media Moderator.  This is for Group and website administration purposes and, unless you have asked us not to, for sending you our monthly newsletter and informing you about training and social events including fundraising for our adopted charity.

 

 

YOUR RIGHTS UNDER THE GDPR

The General Data Protection Regulation (GDPR) came into effect on Friday 25th May 2018.  Under this new Regulation, individuals have more rights with regard to their personal data than ever before.

The aim of this document is to give guidance to WYAMs members about their rights under the GDPR.  It is not a definitive guide; more for information.

  1. Right to be Informed

You have the right to be informed about the collection and use of your own personal data. This is a key transparency requirement under the GDPR.

The organisation (as in the case WYAMs) collecting your personal data must provide you with information including:

  • the purposes for processing your personal data,
  • retention periods for that personal data, and who it will be shared with. This is called ‘privacy information’.

WYAMs must provide privacy information to you at the time of collecting your personal data from you.

If personal data is obtained from other sources, WYAMs must provide you with privacy information within a reasonable period of obtaining the data and no later than one month.

There are a few circumstances when privacy information does not have to be provided, such as if you already have the information or if it would involve a disproportionate effort to provide it to you.

The information provided to you must be concise, transparent, intelligible, easily accessible, and it must use clear and plain language.

  1. Right of Access

The right of access, commonly referred to as subject access, gives you the right to obtain a copy of your own personal data as well as other supplementary information. This helps you to understand how and why your data is being used, and check that it is being done lawfully.

You can make a request (subject access request) verbally or in writing.  WYAMs will respond to your request without undue delay but in any case will respond within one calendar month.

  1. Right to Rectification

In brief: Under Article 16 of the GDPR you have the right to have inaccurate personal data rectified.  You may also be able to have incomplete personal data completed – although this will depend on the purposes for the processing. This may involve providing a supplementary statement to the incomplete data.

You can make a request for rectification verbally or in writing.  WYAMs will respond to your request without undue delay but in any case will respond within one calendar month.

  1. Right to erasure (also known as ‘the right to be forgotten’)

Under Article 17 of the GDPR you have the right to have personal data erased. This is also known as the ‘right to be forgotten’. The right is not absolute and only applies in certain circumstances.  You can make request verbally or in writing.  WYAMs will respond to your request without undue delay but in any case will respond within one calendar month.

One example of why you may request to have your personal data erased is:  the personal data is no longer necessary for the purpose for which it was originally collected or processed.

  1. Right to Restrict Processing

Article 18 of the GDPR gives you the right to restrict the processing of your personal data in certain circumstances. This means that you can limit the way that your data is being used. This is an alternative to requesting the erasure of your data.

You have the right to restrict the processing of your personal data where you have a particular reason for wanting the restriction. This may be because you have issues with the content of the information which is held or how your data has been processed. In most cases your personal data will not be required to be restricted indefinitely, but will need to have the restriction in place for a certain period of time.  When processing is restricted WYAMs is permitted to store your data but not use it.  You can make a request verbally or in writing.  WYAMs will respond to your request without undue delay but in any case will respond within one calendar month.

  1. Right to Data Portability

This gives you the right to receive personal data that you have provided to a controller in a structured, commonly used and machine readable format.  It also gives you the right to request that a controller of your personal data transmits this data directly to another controller.

  1. Right to Object

Article 21 of the GDPR gives you the right to object to the processing of personal data. This effectively allows you to ask for the processing of your personal data to be stopped. 

The right to object only applies in certain circumstances. Whether it applies depends on the purposes for processing and the lawful basis for processing.

You have the right to object to:

  • processing based on legitimate interests or the performance of a task in the public interest/exercise of official authority (including profiling);
  • direct marketing (including profiling); and
  • processing for purposes of scientific/historical research and statistics.
  1. Automated Decision Making & Profiling

Not applicable in the case of WYAMs, however, the GDPR has provisions on:

  • automated individual decision-making (making a decision solely by automated means without any human involvement); and
  • profiling (automated processing of personal data to evaluate certain things about an individual). Profiling can be part of an automated decision-making process.

You can make a ‘Rights’ request verbally or in writing to the WYAMs Group Data Manager This email address is being protected from spambots. You need JavaScript enabled to view it..  WYAMs will deal with your request in a reasonable amount of time but in any case, no later than one calendar month.
